1. About These Membership Terms

1.1 These Membership Terms set out the rules for joining, paying for, and ending a membership at Gracie Barra Bakersfield. They form part of the agreement between you and us when you sign up as a student.

1.2 Please read them carefully before you join. By signing up for a membership, you are agreeing to these terms.

1.3 These Membership Terms should be read alongside our Terms and Conditions, which cover your conduct, physical risk, and your use of our facilities. If there is any conflict between these Membership Terms and our Terms and Conditions, these Membership Terms will apply to anything related to payment and membership.

1.4 If you are under 18, a parent or guardian must read and agree to these terms on your behalf before a membership can be set up.


2. Membership Types and Pricing

2.1 We offer a range of membership options. Full details of the membership types currently available, including their names, access levels, and prices, are published on our website at gbbakersfield.com.

2.2 The membership type you are signing up for, and the price you are paying, will be confirmed in writing at the point of sign-up. If anything is unclear, please contact us at info@gbbakersfield.com before you proceed.


3. Joining Fees and Registration

3.1 Some membership types require a one-off joining fee or registration fee in addition to the regular membership payment. Where this applies, it will be clearly shown on our website and confirmed at the point of sign-up.

3.2 Joining fees are non-refundable unless you cancel within the cooling-off period described in Section 6.


4. How We Collect Payments

4.1 Membership payments are collected through Ashbourne Management Services (our membership management provider). You will be asked to set up a payment method when you join.

4.2 We currently accept payment by direct debit (for membership payments) and card (for certain purchases), including card payments processed via Zettle by PayPal (iZettle).

4.3 Your membership payments are collected on a monthly basis unless your membership plan states otherwise.

4.4 Your first payment will be taken on or around the date you sign up (or another start date agreed in writing). Subsequent payments will be collected on the same date in each billing cycle.


5. Failed Payments

5.1 If a payment fails, we (or Ashbourne on our behalf) may attempt to collect it again.

5.2 If a payment remains outstanding, we may suspend your membership until the outstanding amount is cleared. Suspension means you will not be able to attend training until your account is brought up to date.

5.3 We do not currently charge a failed payment fee unless we tell you in writing in advance.

5.4 It is your responsibility to make sure your payment details are kept up to date. If your bank details change, you must update them through Ashbourne or by contacting us at info@gbbakersfield.com before your next payment is due.


6. Cooling-Off Period

6.1 Under the Consumer Contracts Regulations 2013, you have the right to cancel a new membership within 14 days of signing up, without giving a reason, and receive a full refund. This is your statutory cooling-off period.

6.2 However, if you attend a training session during those 14 days, you are asking us to begin providing the service before the cooling-off period ends. By doing so, you agree that you will lose the right to a full refund. If you then cancel within the 14-day window, we may charge a proportionate amount for any sessions you have already attended.

6.3 To cancel within the cooling-off period, please contact us in writing at info@gbbakersfield.com as soon as possible.


7. Cancelling Your Membership

7.1 You can cancel your membership at any time by giving written notice. Your cancellation will take effect at the end of your notice period (Section 7.3) or at the end of your minimum commitment period (Section 8), whichever is later.

7.2 To cancel, you must give us written notice by either:

  1. emailing us at info@gbbakersfield.com; or
  2. delivering written notice in person at the academy, provided it is acknowledged in writing by a member of staff at the time.

7.3 Your cancellation notice must be given at least two full calendar months before you want your membership to end, starting from the first day of the month after the month in which you give notice. For example, if you give notice on any day in March, your membership will end on 31 May.

7.4 If you give notice during your 16-week minimum commitment period, your notice period and your minimum commitment period run at the same time. Your membership will end on whichever date is later. For example, if you sign up on 1 March (so your 16-week minimum ends on 21 June) and you give notice on any day in March, your two-month notice period would end on 31 May. Because your 16-week minimum runs to 21 June, your membership will end on 30 June (the end of the calendar month in which the 16-week period falls). You can give notice as early as your sign-up date if you wish, so long as you have completed at least the 16-week minimum by the time your membership ends.

7.5 Your membership payments will continue to be collected during your notice period and any remaining minimum commitment period. You are entitled to continue training during this time.


8. Minimum Commitment Period

8.1 Unless the package you sign up for states otherwise, all memberships have a minimum commitment period of 16 weeks from your sign-up date. You can give notice to cancel at any time, but your membership cannot end before the 16-week minimum is complete. See Section 7 for how the notice period and the minimum commitment period work together.

8.2 If you pay annually, your payment covers a full 12 months. Annual payments are non-refundable, subject to your statutory rights under Section 6. If you wish to cancel after the cooling-off period has ended, no refund will be given for the remaining months.

8.3 Some packages are defined endpoint packages. These have a fixed end date set at the point of sign-up. They do not need to be cancelled because they end automatically on that date. The cancellation process in Section 7 does not apply to defined endpoint packages. Where a package is a defined endpoint package, this will be clearly stated on the package.


9. Freezing Your Membership

9.1 You can ask to freeze your membership if you need to take a temporary break from training.

9.2 The following conditions apply to all freezes:

  1. You must give at least 14 days’ written notice to request a freeze. Notice should be sent to info@gbbakersfield.com.
  2. Freezes take effect from the first day of the month following your notice, provided at least 14 days’ notice has been given before the end of that month. For example, notice given on 20 March is less than 14 days before 1 April, so the freeze would begin on 1 May instead. Notice given on or before 17 March would allow a freeze to begin on 1 April.
  3. The minimum freeze period is one full calendar month.
  4. The maximum freeze period for any single request is three calendar months.
  5. You may not freeze your membership for more than three months in total within any rolling 12-month period.
  6. While your membership is frozen, no regular membership payments will be collected.
  7. Before your freeze begins, you must pay in advance for the first billing period after your membership reactivates. For example, if you are on monthly billing, give notice in March, and your freeze runs from 1 April to 1 May, your May payment must be made before 1 April. Your regular billing cycle will then resume from 1 June onwards. If you are on 28-day billing, the same principle applies: the first 28-day period after your freeze ends must be paid before the freeze begins.
  8. Your membership will reactivate automatically at the end of your freeze period. The billing period covered by your advance payment will not be charged again.
  9. You cannot cancel your membership during a freeze period. Your cancellation notice period begins from the date your membership reactivates.
  10. A freeze pauses your membership clock. If you are within your 16-week minimum commitment period, the clock resumes from where it stopped when your membership reactivates. If you are on an annual membership, your end date will be extended by the same number of months you were frozen for.

9.3 In exceptional circumstances, such as serious illness, long-term injury, or pregnancy, we may agree to a freeze that goes beyond the limits set out above. This is at our discretion. To request an extended freeze, please contact us in writing at info@gbbakersfield.com with details of your situation. We may ask for supporting documentation before making a decision.

9.4 Freeze requests must be made in writing. We are not able to apply a freeze retrospectively.


10. Pro-Rata Charges

10.1 If you join partway through a billing cycle, your first payment may be a pro-rata amount covering only the remaining days in that cycle. This will be confirmed at the point of sign-up.

10.2 There is no pro-rata charge when your membership reactivates after a freeze. Your reactivation billing period is paid in advance as described in Section 9, and your regular billing then resumes from the following cycle.


11. Price Changes

11.1 We may change membership prices from time to time. We will always give you at least 30 days’ written notice of any price increase before it takes effect, and we will endeavour to give more notice than this wherever we can.

11.2 Notice of a price change will be sent to the email address we hold for you. It is your responsibility to make sure your contact details are kept up to date.

11.3 If you do not wish to continue your membership at the new price, you may cancel by following the process in Section 7. Your notice period will run from the date you give notice, not from the date the price change takes effect.


12. Your Membership Is Personal to You

12.1 Your membership is personal to you and cannot be transferred to another person. It cannot be sold, gifted, or shared. Only the named student may use the membership to attend sessions.


13. When We May End Your Membership

13.1 We reserve the right to end your membership at our discretion. Situations where we may do this include, but are not limited to, cases where you:

  1. behave in a way that breaches our Terms and Conditions or Code of Conduct;
  2. act in a way that puts other students, coaches, or staff at risk of harm;
  3. behave in a threatening, abusive, or discriminatory way;
  4. fail to bring your account up to date within a reasonable time after a payment failure;
  5. bring the academy into disrepute.

13.2 Where we end your membership for conduct reasons, no further payments will be taken from the date of termination. We will not refund any payments already collected for the current billing cycle.

13.3 Where we end your membership for reasons unrelated to your conduct, we will give you reasonable written notice and refund any amounts paid for a period after termination takes effect.


14. Complaints

14.1 If you have a complaint about your membership or the way a payment has been handled, please contact us in the first instance at info@gbbakersfield.com. We will aim to respond within 5 working days.

14.2 If we cannot resolve your complaint directly, you may be able to seek further help through your local Trading Standards office or through the courts. Your statutory rights as a consumer are not affected by anything in these Membership Terms.


15. Governing Law

15.1 These Membership Terms are governed by the laws of England and Wales. Any disputes arising from them will be subject to the jurisdiction of the courts of England and Wales.


16. If Part of These Terms Is Unenforceable

16.1 If any part of these Membership Terms is found to be invalid or unenforceable by a court, the remaining sections will continue to apply in full. The rest of the terms are not affected.
